High Court issues notices to State election commission for fresh election schedule
INDORE: A PIL has been filed before the Indore bench of Madhya Pradesh High Court on Tuesday demanding announcement of fresh election schedule before the expiry of tenure of existing representative body of IMC. The divisional bench of Justices PK Jaiswal and S Waghmare has issued notices to state election commission ( SEC), state and civic body directing to file their reply in 10 days.
Former BJP corporator Shyamalal Rajdev had filed a petition through his lawyer Manish Yadav requesting the court to direct the election commission for announcement of poll schedule before the expiry of existing representative body of IMC on January 10, 2015.
"As per section 243 (U) of Madhya Pradesh Municipal Corporation Act and Constitution of India, election schedule for an elected body should be announced before the expiry of its tenure," said Yadav. Petitioner said if election schedule is not announced before the end of tenure then there would be no mayor, MiC and corporators in IMC, which would lead to chaos as functioning of the IMC would be affected.
